Copyright and Takedown Policy
VYBE (the apps and vybemusic.com) is operated by CodeFather L.L.C-FZ, United Arab Emirates. VYBE is a place for artists to showcase their own work, and we respect the rights of artists, songwriters, labels, publishers and everyone else who creates. This policy explains how to report content you believe infringes your copyright, how the person who uploaded it can respond, and what we do about repeat infringement.
Who can upload
Only artists who accept the VYBE Artist Agreement can upload music. They promise that they own or control all rights in what they upload, including recordings, songs, samples, artwork and videos. When they do not, this policy gives rights holders a fast way to have the content removed.
Checks at upload
Every upload goes through automated checks before and after it is published. These include audio fingerprinting, duplicate detection against music already on VYBE, and metadata checks (for example ISRC, UPC, titles and artist names). If a check finds a likely match with someone else's music, we may block the upload, hold it for review, ask the uploader for proof of rights, or limit where it appears. No automated system is perfect, so these checks do not replace notices from rights holders, and passing them does not mean an upload is licensed.
Sending a copyright notice
If you believe content on VYBE (or in a partner app that receives music from VYBE) infringes a copyright you own or are authorised to act for, email [email protected] with the subject "Copyright notice". Your notice must include:
- your physical or electronic signature (typing your full name is enough);
- a description of the copyrighted work you say is infringed (for example the song title, artist, ISRC or a link to the original), or a representative list if there are several;
- the exact location of the content on VYBE: a link to each track, release, video or profile, so we can find it;
- your name, postal address, phone number and email address, and if you act for someone else, who you represent;
- a statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent or the law; and
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner of the right or authorised to act on the owner's behalf.
Notices that leave out required information may take longer to process, or we may ask you to complete them.
What happens next
When we receive a valid notice we act quickly: we remove or disable access to the content, stop offering it to partner apps, and pause any sales of it. We tell the uploader, and we may share your notice with them (including your name and email) so they can respond or contact you. Partner apps must remove it within the period set in our Library API and Partner Terms. We may hold payouts related to the content while the matter is open.
Counter-notices
If your content was removed and you believe it was a mistake or misidentification, or that you have the rights to use it, you can send a counter-notice to [email protected] with the subject "Copyright counter-notice". It must include:
- your physical or electronic signature;
- a description of the content that was removed and where it appeared before removal;
- a statement, under penalty of perjury, that you have a good faith belief the content was removed as a result of a mistake or misidentification;
- your name, address, phone number and email address; and
- a statement that you consent to the jurisdiction of the courts for your address (or, if your address is outside the United States, any judicial district in which VYBE may be found, or the courts of Dubai, United Arab Emirates), and that you will accept service of process from the person who sent the original notice or their agent.
We forward a valid counter-notice to the person who sent the original notice. If they do not tell us within 10 business days that they have started legal action to stop the infringement, we may restore the content between 10 and 14 business days after we received the counter-notice. We may decide not to restore content where we have other reasons to believe it breaks our rules.
Notices from other countries
The process above is based on the United States Digital Millennium Copyright Act (DMCA), and we apply it to notices from every country. We also accept notices made under other laws, such as the notice and action rules of the EU Digital Services Act and the copyright laws of the United Arab Emirates, the United Kingdom and other countries. You do not need to cite a particular law. Just give us the information listed above so we can find the content and understand your claim. Uploaders can respond to any notice in the same way as a counter-notice, and can ask us to review our decision.
Other rights and disputes
For trademark, privacy, likeness or voice (including AI imitation of a real person) complaints, email [email protected] with a clear subject line and the same kind of details. If you are a co-writer, producer or co-owner and disagree with how a release is credited or split, tell us. We may hold the release and related payouts while you sort it out with the uploader, but we cannot decide ownership disputes between you.
Repeat infringers
We count a "strike" against an account each time we remove content because of a valid copyright notice that is not successfully countered. Strikes expire after 12 months. When an account reaches three active strikes, we close it and remove its content, and the person may not open a new artist account. We may close an account sooner, even after a single notice, where the infringement is deliberate, large scale or combined with fraud. Strikes are removed if a counter-notice succeeds or the notice is withdrawn.
False claims and misuse
Do not send a notice or counter-notice unless you are sure of your rights. In some countries, including the United States, anyone who knowingly makes a material misrepresentation in a notice or counter-notice can be liable for damages, including costs and legal fees. We may ignore notices that are abusive, made in bad faith or used to compete unfairly, and we may stop accepting notices from people who repeatedly send them.
Designated agent
CodeFather L.L.C-FZ registers a designated agent to receive copyright notices where the law requires it, including with the United States Copyright Office. Until a registration lists a different address, the designated contact for all copyright notices is:
Copyright Agent, CodeFather L.L.C-FZ (VYBE), United Arab Emirates
Email: [email protected] (subject "Copyright notice")
Artists and rights holders
If you are an artist on VYBE and want to remove your own music, use VYBE Studio. If you are a label, publisher, distributor or collecting society and want to talk to us about your catalogue, or to set up a faster way to send notices, email [email protected]. Sending us information is not legal advice, and you may want to speak to a lawyer about your rights.
